US Appeals Court rules against TransCore on patents

A US appeals court has ruled against TransCore in a patent infringement challenge to Electronic Transaction
Consultants Corp (ETC) work at the Illinois Tollway in a ruling handed down this week. The
appeals court agreed with a May 2008 district court ruling that patents had expired and ETC had implied license rights following a 2001 settlement agreement between TransCore and Mark IV, the supplier of transponder-reader systems. The legal doctrine of estoppel - precedent in english - was also asserted to favor ETC.
The appeals court in a 15 page judgment agreed with the district court on all points.
